Tropical Elementary School - South Courtenay Parkway Sidewalk Relocation - Interlocal Agreement

Discussion
The sidewalk adjacent to South Courtenay Parkway between Brandy Lane and Moore Avenue is very close to the road.  Tropical Elementary School has a large number of children (some accompanied by parents) who walk or ride their bicycle to/from school using this sidewalk.  Conflicts occur because parents in vehicles also use this area, either parking on the sidewalk or very close to the sidewalk, to wait in line to pick up their children.  This situation has been a longstanding safety concern.

Project Management staff met on site with the Principal, District Security and Brevard County Engineering staff and observed/confirmed the situation.  The problem is remedied by relocating the existing sidewalk further west away from the road, similar to the location of the sidewalk between Tropical Elementary and Brandy Lane.

District staff and Brevard County staff have worked together to develop a plan to relocate the sidewalk.  The team is proposing a 50/50 cost share, as outlined in the proposed Interlocal Agreement.  The District's share will be half of the cost of engineering (up to $10,497.50); half the cost of construction (up to $75,000) and half the cost of any construction change orders (limited District funding of $15,000 cumulative without School Board approval). The total maximum District Share of the project is $100,497.50.  The funding source is the fuel tax rebate.

Brevard County has advance-funded the engineering work in order to have the project designed and permitted for summer 2016 construction.  Brevard County's in-house construction team will build the project.

The draft Interlocal Agreement has been reviewed and approved by the School Board Attorney.  Minor changes may be requested by the County Attorney's Office, in which case the School Board Attorney will also review the final version prior to execution of the Interlocal Agreement.

Board approval is required for purchase orders over $50,000.  In order to expedite the work, approval is requested as a consent item without prior information.


Recommendation
Approve the Interlocal Agreement with Brevard County for the design and construction of the Tropical Elementary School Access Improvements (sidewalk relocation), subject to final review by the School Board Attorney.
