Resolution Related to Voter Referendum

Discussion

The attached resolution has been drafted related to placing a referendum on the November 2, 2010, ballot.  The purpose of this agenda item is to request School Board approval of the resolution and submittal of the official ballot language to the Supervisor of Elections.  As a point of information, staff has already provided a copy of the proposed ballot language to the Supervisor of Elections' office to insure proper wording and format.  The final official ballot language must be received by the Supervisor of Elections no later than August 24, 2010, in order to be placed on the November 2, 2010 ballot. Upon School Board approval, the official ballot language will be sent to the Brevard County Commission, who will in turn forward it to the Supervisor of Elections. 

Per section 101.161(1), Florida Statutes in reference to the ballot language:

  •       The title is limited to 15 words
  •       The actual language of the referendum is limited to 75 words
  •       No verbiage can follow the words "Yes" and "No"

AUTHORITY OF THE SCHOOL BOARD TO CONTINUE TO LEVY 0.25 MILLS FOR CRITICAL OPERATING NEEDS

 

Shall the school board have the authority, by an annual super majority vote for the 2011-2012 and 2012-2013 fiscal years, to continue to levy 0.25 mills for critical operating needs pursuant to Section 1011.71(3)(b), Florida Statutes?

As a point of information the entire resolution must be printed in the newspaper twice.  We estimate that it will take between 1/4 and 1/2 page each time at a total estimated cost of $5,800.  

 



Recommendation

Approve the attached Resolution and authorize the Superintendent to forward the official ballot language to the Brevard County Commission.
