09-25-2018 Rule Development Workshop


The School Board of Brevard County, Florida met for a Rule Development Workshop on Tuesday, September 25, 2018 at the Educational Services Facility, 2700 Judge Fran Jamieson Way, Viera, Florida. Notice of the meeting was advertised in the Eagle newspaper on Thursday, September 6, 2018. The affidavit of publication with a copy of the ad attached is filed in the Affidavit File in the Board Office.

Opening Exercises

Chairman Craig called the workshop to order at: 2:04 p.m.

The purpose of the rule development workshop serves as the first public hearing for policy revisions providing opportunity for the public to make comments concerning the proposed revisions. A division head from each sponsoring department read the revisions. 

All of the proposed changes encompass suggested language from NEOLA.

Elementary Leading and Learning sponsors Policy 2240, Controversial Issues and Assistant Superintendent Jane Cline, read an overview of the proposed revisions.

5. Policy 2520 Selection of Instructional Materials

Minutes: 

Elementary Leading and Learning sponsors Policy 2520, Selection of Instructional Materials and Assistant Superintendent Jane Cline, read an overview of the proposed revisions.

General Counsel Envall provided more detail into the revisions. Ms. Cline explained that the process is tighter and in alignment with statutes.

6. Policy 3210 Standards of Ethical Conduct

Minutes: 

Human Resources sponsors policy 3210, Standards of Ethical Conduct and the overview of the proposed revisions was read by Rivers Lewis, director of Professional Standards and Labor Relations.

Board discussion ensued regarding the proposed changes to the policy. A determination was made for each Board member to send his or her suggestions regarding the proposal to General Counsel Envall for compilation and further discussion.

7. Policy 3211 Whistleblower Protection

Minutes: 

Policy 3211, Whistleblower Protection, is sponsored by The Board.  As such, General Counsel Envall provided a synopsis.

Board discussion ensued.  Board members agreed to take out the word "conducted" in the last paragraph and have it read "... an investigation shall be facilitated by the School Board attorney..."

8. Policy 5772 - Weapons

Minutes: 

Dr. Beth Thedy, Deputy Superintendent and Chief Operating Officer, provided the overview of changes to Policy 5722 Weapons as sponsored by District Operations.

Mr. Ziegler wanted to go over a part in paragraph three about intent.  He said that common sense should prevail. Mr. Ziegler believed that some  guidelines for principals should be developed to help make determinations regarding intent.

9. Policy 7217 Weapons

Minutes: 

Dr. Thedy provided the revision rationale for policy 7217 Weapons.

Board members expressed some concerns and had several questions. Dr. Mullins wanted to review statute and come back with that information.

Ms. Envall asked if the Board wanted this policy to move forward on the October 10, Board meeting and revise again later if necessary. Board consensus was to move forward and revise as necessary.

10. Policy 8210 School Calendar

Minutes: 

Mr. Lewis provided an overview of the revisions to School Board Policy 8210 on School Calendar.

Ms. Descovich asked about adding religious holidays as a reference for when events such as open house, field trips, etc. are being planned. Additionally, Mr. Craig asked how to ensure school events such as an open house are not scheduled during on Primary Election day.

Elementary and Secondary Leading and Learning assistant superintendents, Ms. Cline and Dr. Soliven stated that they will assume the responsibility for getting out the word to schools for certain recognized holidays and events for planning purposes.

11. Policy 8800 Religious/Patriotic Ceremonies and Observances

Minutes: 

Christine Moore, assistant superintendent of Student Services, provided the revisions in School Board policy 8800 Religious/Patriotic Ceremonies and Observances.

Brief Board discussion ensued and statute concerning reciting the Pledge was read.

12. Policy 8810 The American Flag

Closing Remarks
14. Closing Remarks

Minutes: 

Following the conclusion of the public hearing for policies, Chairman Craig expressed that there were some items that needed to be discussed at this publicly noticed meeting.

  • RSM Audit Report Regarding Whistleblower Complaint
  • Brevard County School Board Investigative Report from Sniffen & Spellman, P.A.

It was suggested that outside legal counsel be obtained should the retaliation allegations investigated by lawyers Sniffen & Spellman proceed further.  Board consensus was to have Chairman Craig work with General Counsel Envall to find outside counsel that has not had formal dealings with either the person who filed the complaint or members of the School Board of Brevard County. Following that process, Chairman Craig will bring a recommendation to the Board. Findings from this investigation may be provided in response to a public records request after redaction of any confidential and/or exempt information.

Results of the audit in response to the whistleblower complaint had been provided to the Board. Members discussed the way the initial report had been handled as well as necessary next steps. The report can be provided in reply to a public records request after  redaction of confidential and/or exempt information.
