Agenda Item #31
Submission of Policies and Procedures for the Provision of Specially Designed Instruction and Related Services for Exceptional Students (SP&P) Documents for the 2008-2009 School Year
Florida Statutes require that district school boards submit to the Department of Education (DOE) proposed procedures for the provision of special instruction and services for exceptional students once every three years. Rule 6A-6.03411, Florida Administrative Code (FAC.), requires the approval of this document by the Department as a prerequisite for districts' use of weighted cost factors under the Florida Education Finance Program (FEFP). This document also serves as the basis for the identification, evaluation, eligibility determination, and placement of students in special programs for exceptional students, and is a component of our district's application for supplemental student funds available under the Individuals with Disabilities Education Act (IDEA).
On October 13, 2006 the final federal regulations implementing the 2004 amendments to IDEA became effective. A number of additional new rules were approved in December 2006 and an additional group of new/revised rules were approved on June 17, 2008. Final adoption of these rules is on hold pending a response to a request for information from the Joint Administrative Procedures Committee (JAPC) and a response to a challenge filed on July 18, 2008. Until such time as the rules are adopted, the current rules remain in effect. As a result, our district's current Policies and Procedures for the Provision of Specially Designed Instruction and Related Services for Exception Students (SP&P), as amended, remains in effect. During this interim period, documentation of school board approval for an extension of the current document is required.
The Florida Department of Education requires this extension without any changes or substitutions at this time. Your approval allows us to continue to operate under current statute as we wait for the new state document to be approved.
SP&P contains state statutes and policy and is not available in an electric document. The Brevard ESE Count Plan which is available electronically includes all of these statutes and policies, as well as our specific Brevard procedures that ensure compliance. Brevard's ESE County Plan is available at http://esen.brevard.k12.fl.us/default.html.
A hard copy of the SP&P is available for viewing in the Office of Exceptional Education.
Due to time constraints, we request approval of the Board without prior information.
Approve the extension of the existing Policies and Procedures for the Provision of Specially Designed Instruction and Related Services for Exceptional Students (SP&P).
