Kennedy Middle School - Design Build Services Guaranteed Maximum Price Amendment - SALES SURTAX


Kennedy Middle School is one of several sales surtax projects that are being done through the design build contract methodology. The process starts with the development of the Design Criteria Package (DCP) which is then used as the basis for the request for proposals from design build contractors. RFP #16-P-070-DR was issued for the package of Saturn Elementary School, Kennedy Middle School and Fairglen Elementary School to reduce administrative time and cost while achieving some economies of scale from the selected design builder. Four proposals were received and Welsh Companies was awarded the contract and preconstruction services at the April 26, 2016 Board meeting. The GMP for Saturn Elementary School was approved October 25, 2016 and the GMP for Fairglen Elementary School is still under development and review.

The scope of work for this project includes all of the facility renewal items on the Sales Surtax Funded Detail Report (Attachment F), the district school security items and the classroom technology infrastructure.

The design is 100% complete and Welsh Companies has submitted a Guaranteed Maximum Price (GMP) amendment in an amount not to exceed $2,206,271. The work is planned for summer 2017. Long lead time items will be ordered following the approval of the GMP. 

The proposal also includes the following additive alternatives that are recommended for funding:

  • Gym air conditioning             $187,377(capital)
  • HVAC controls system          $295,158 (surtax contingency)
  • Site drainage correction         $  19,681 (capital)

The additive alternates are all recommended for funding. The Independent Citizens Oversight Committee was briefed on the contingency item at their October 2016 meeting. The HVAC controls system will be funded partially through the Attachment F allocation to facility renewal ($40,000) and partially through facility renewal surtax contingency ($255,158).  

As the project moves forward, actual costs will be allocated to the sales surtax group and category as appropriate based on the attached worksheet. The costs for the Design Criteria Package, design and preconstruction services and administrative costs total $224,964.72 in surtax and are indicated in the spent and encumbered column of the attached worksheet. Capital funds were also budgeted for design of non-surtax items $12,331.54). Project costs are within the Attachment F funding allocation, which allowed partial funding of the HVAC controls system. Surtax funds have been reserved for the relocatable covered walkways per Attachment F ($153,600). Administration, permitting and inspection costs are estimated at $97,000.

Capital funds needed for the project for non-surtax-eligible components total $207,058. An additional $5,000 is requested from capital to cover administration, permitting and inspection for these components. 

Board approval is required for purchase orders over $50,000. Approval is requested without prior information in order to expedite the work.


Approve the total project construction and administration budget in the amount of $2,810,487 for the Kennedy Middle School renewal project.

Approve the Guaranteed Maximum Price amendment to the design build services contract with Welsh Companies in an amount not to exceed $2,708,487.

Approve the additive alternates to be included in the GMP:

  • Gym air conditioning             $187,377(capital)
  • HVAC controls system          $295,158 (surtax contingency)
  • Site drainage correction         $  19,681 (capital)
